These Terms and Conditions govern your use of pongozone.com and purchases from Pongo Zone LLC. By using this website or placing an order, you agree to these terms, our Return Policy, and our Privacy Policy.
1. ELIGIBILITY
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order.
You are responsible for providing complete and accurate account, billing, payment, and shipping information.
2. PRODUCTS
All Pongo Zone products are print-on-demand and made specifically after an order is placed.
We make reasonable efforts to display product descriptions, designs, measurements, prices, and colors accurately. However:
• Colors may appear differently depending on the screen or device
• Product placement and printing may vary slightly
• Garment measurements may have minor manufacturing variations
• Product availability may change without notice
Please review the product description, available options, and size guide carefully before ordering.
3. ORDERS
Submitting an order does not guarantee acceptance. Pongo Zone may cancel or refuse an order because of:
• Payment or fraud concerns
• Incorrect pricing or product information
• Product unavailability
• An incomplete or undeliverable address
• Suspected unauthorized activity
• A website or technical error
• Another reasonable business or legal concern
If we cancel an order before it is produced, any amount collected for the canceled item will be refunded to the original payment method.
Customers will receive an order confirmation by email. Please review it immediately and contact support@pongozone.com if anything is incorrect.
4. PRICES AND PAYMENT
Prices are shown in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, customs charges, or other fees may be added during checkout.
Payment must be successfully authorized before an order can be processed.
We may correct pricing, description, or calculation errors. If a correction materially changes an order that has not entered production, we will contact the customer or cancel and refund the affected item.
5. CHANGES AND CANCELLATIONS
Contact us immediately if you need to change or cancel an order.
Because orders may enter production shortly after being submitted, changes and cancellations are not guaranteed.
Once production begins, the order generally cannot be changed or canceled. Customer-requested changes after production begins do not qualify for an automatic refund.
6. PRODUCTION AND SHIPPING
Production and delivery dates are estimates unless expressly stated otherwise. Delivery may be affected by carrier delays, weather, customs processing, seasonal demand, or other circumstances outside our control.
Customers are responsible for providing a complete and accurate shipping address and for monitoring tracking information.
When an order cannot be shipped within the promised time, Pongo Zone will provide the delay, cancellation, or refund options required by applicable law.
Lost packages, incorrect addresses, unclaimed packages, delivery problems, international shipments, and reshipping costs are handled according to our Return Policy.
Ownership and risk of loss transfer as provided by applicable law and the delivery arrangements used for the order.
7. INTERNATIONAL ORDERS
International customers are responsible for any customs duties, import taxes, brokerage charges, or other fees imposed by the destination country unless those amounts were collected during checkout.
Pongo Zone does not control customs inspections, delays, or charges.
Customers are responsible for supplying any information required for international delivery, including an accurate address, telephone number, or customs identification information where applicable.
8. RETURNS, REFUNDS, AND REPLACEMENTS
Because all products are print-on-demand, we do not accept routine returns or exchanges for:
• Selecting the wrong size, color, style, or product
• Change of mind
• Disliking the fit of a correctly produced item
• Other customer ordering mistakes
Damaged, defective, misprinted, incorrect, lost, or qualifying fulfillment problems are handled under our Return Policy.
Do not mail a product to Pongo Zone or the return address on a package without first receiving written authorization.
Our Return Policy is incorporated into these Terms and Conditions.
9. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes:
• Must be used before their expiration date
• May be limited to certain products or customers
• May not be combined unless specifically allowed
• Have no cash value
• Cannot normally be applied after an order is submitted
Pongo Zone may modify or end a promotion when permitted by law. We may reject the unauthorized, fraudulent, or abusive use of discounts.
10. INTELLECTUAL PROPERTY
The Pongo Zone name, logos, website design, product designs, graphics, photographs, text, and other original content are owned by Pongo Zone LLC or used with permission. They are protected by applicable intellectual-property laws.
You may use the website only for personal shopping and other lawful purposes.
You may not copy, reproduce, distribute, sell, modify, scrape, republish, or commercially use website content or product designs without written permission.
Product purchases do not transfer ownership of any design, copyright, trademark, or other intellectual-property right.
11. PROHIBITED USE
You may not use the website to:
• Break any law
• Commit fraud or make unauthorized purchases
• Interfere with website security or operation
• Introduce viruses, malicious code, or automated attacks
• Collect information about other users
• Copy or misuse Pongo Zone content
• Misrepresent your identity
• Use the website in a way that harms Pongo Zone, its customers, or service providers
Access may be restricted or terminated when these terms are violated.
12. THIRD-PARTY SERVICES
Pongo Zone uses outside providers for website hosting, payments, order production, shipping, security, analytics, and other services.
Links to outside websites or services may be provided for convenience. Pongo Zone does not control those outside services and is not responsible for their independent content, availability, or privacy practices.
13. WEBSITE AVAILABILITY AND WARRANTIES
We work to keep the website accurate, secure, and available, but we cannot guarantee that it will always operate without interruption, delay, or error.
To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. Nothing in these terms excludes warranties or consumer protections that cannot legally be excluded.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Pongo Zone LLC will not be liable for indirect, incidental, special, or consequential losses resulting from use of the website or a product.
For a claim relating to a purchase, Pongo Zone’s total liability will not exceed the amount paid for the affected product, except where applicable law requires otherwise.
These limitations do not apply to liability that cannot legally be limited or excluded.
15. GOVERNING LAW
These terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.
Nothing in these terms prevents a customer from exercising consumer rights that cannot legally be waived.
16. CHANGES TO THESE TERMS
We may update these Terms and Conditions when our business, website, services, or legal obligations change.
The revised terms will be posted on this page with a new “Last updated” date. Changes apply to website use and orders placed after the updated terms take effect.
17. SEVERABILITY
If any part of these terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
